§ 4. Składanie Zamówień i zawarcie Umowy

  2. Zamówienia można składać przez całą dobę, we wszystkie dni tygodnia. Złożenie Zamówienia nie wymaga założenia Konta.
  3. W celu złożenia Zamówienia Klient:
    1. wybiera Produkt i jego wariant (w szczególności rozmiar, wykończenie lub wersję w ramce) i dodaje go do Koszyka;
    2. przechodzi do formularza zamówienia;
    3. podaje adres e-mail oraz, w przypadku Produktów fizycznych, dane do dostawy;
    4. wybiera sposób dostawy i metodę płatności;
    5. zapoznaje się z podsumowaniem Zamówienia, obejmującym w szczególności Produkty, ich główne cechy oraz łączną cenę wraz z kosztami dostawy i wszelkimi innymi kosztami;
    6. klika przycisk „Pay now” (albo przycisk o równoważnym znaczeniu w innej wersji językowej formularza zamówienia), oznaczający złożenie zamówienia z obowiązkiem zapłaty, i dokonuje płatności.
  4. Do chwili kliknięcia przycisku, o którym mowa w ust.

§ 5. Ceny i płatności

§ 6. Realizacja i dostawa

Produkty fizyczne

  2. Sklep realizuje dostawy wyłącznie na adresy w następujących krajach: Polska, Australia, Austria, Belgia, Czechy, Dania, Finlandia, Francja, Hiszpania, Hongkong, Irlandia, Izrael, Japonia, Kanada, Korea Południowa, Malezja, Niderlandy, Niemcy, Norwegia, Nowa Zelandia, Portugalia, Singapur, Stany Zjednoczone, Szwajcaria, Szwecja, Wielka Brytania, Włochy, Zjednoczone Emiraty Arabskie.
  3. Sposoby i koszty dostawy:
    1. dostawa na terenie Polski, Standard: 20 zł; dostawa Standard jest bezpłatna, jeżeli łączna cena Produktów w Zamówieniu po uwzględnieniu rabatów, bez kosztów dostawy, wynosi co najmniej 200 zł;
    2. dostawa na terenie Polski, Express (przesyłka kurierska ekspresowa): 65 zł;
    3. dostawa do pozostałych krajów wymienionych w ust. 2: 70 zł.
    Koszt dostawy właściwy dla danego Zamówienia jest wskazywany w formularzu zamówienia przed złożeniem Zamówienia.
5431 Kodeksu cywilnego.

Produkt cyfrowy (Wallpaper Pack)

  2. Termin do odstąpienia od Umowy rozpoczyna się:
    1. w przypadku Produktów fizycznych: od objęcia Produktu w posiadanie przez Konsumenta lub wskazaną przez niego osobę trzecią inną niż przewoźnik, a jeżeli Umowa obejmuje wiele Produktów dostarczanych osobno, partiami lub w częściach: od objęcia w posiadanie ostatniego Produktu, partii lub części;
    2. w przypadku Produktu cyfrowego: od dnia zawarcia Umowy.
  4. Aby odstąpić od Umowy, Konsument składa Sprzedawcy oświadczenie o odstąpieniu od Umowy, w szczególności:
    1. za pomocą Formularza odstąpienia online dostępnego pod adresem /pages/withdrawal (Odstąp od umowy tutaj);
    2. pocztą elektroniczną na adres: paugalk.store@gmail.com;
    3. pisemnie na adres: PauGalk Design Studio Paulina Gałka, Al. Młodości 45, 23-400 Biłgoraj, Polska.
    Konsument może skorzystać ze wzoru formularza odstąpienia od umowy stanowiącego Załącznik nr 1 do Regulaminu, jednak nie jest to obowiązkowe. Do zachowania terminu wystarczy wysłanie oświadczenia przed jego upływem.
Zwrot nie wymaga oryginalnego opakowania; Sprzedawca prosi jedynie o zapakowanie Produktu w sposób chroniący go przed uszkodzeniem w transporcie.
  11. Konsument ponosi bezpośrednie koszty zwrotu Produktu fizycznego (koszt jego odesłania do Sprzedawcy).
  12. Konsument ponosi odpowiedzialność za zmniejszenie wartości Produktu fizycznego będące wynikiem korzystania z niego w sposób wykraczający poza konieczny do stwierdzenia charakteru, cech i funkcjonowania Produktu.
Nie ogranicza to innych uprawnień Konsumenta wynikających z przepisów prawa.
  14. W przypadku Produktu cyfrowego (Wallpaper Pack):
    1. prawo odstąpienia od Umowy nie przysługuje wyłącznie wtedy, gdy łącznie: Sprzedawca rozpoczął dostarczanie Produktu cyfrowego za wyraźną i uprzednią zgodą Konsumenta, Konsument został poinformowany przed rozpoczęciem świadczenia, że po jego spełnieniu przez Sprzedawcę utraci prawo odstąpienia od Umowy, i przyjął to do wiadomości, a Sprzedawca przekazał Konsumentowi potwierdzenie zawarcia Umowy na Trwałym nośniku, obejmujące informację o udzielonej zgodzie;
    2. jeżeli Konsument nie wyraził takiej zgody lub nie przyjął do wiadomości utraty prawa odstąpienia od Umowy, albo jeżeli Sprzedawca nie przekazał potwierdzenia, o którym mowa w pkt 1, prawo odstąpienia od Umowy przysługuje Konsumentowi na zasadach ogólnych przez 14 dni od dnia zawarcia Umowy, także wtedy, gdy Produkt cyfrowy został już dostarczony; Konsument nie ponosi w takim przypadku kosztów dostarczenia Produktu cyfrowego;
    3. po odstąpieniu od Umowy Konsument jest obowiązany zaprzestać korzystania z Produktu cyfrowego i udostępniania go osobom trzecim.

    1. Sprzedawca odmówił doprowadzenia Produktu do zgodności z Umową;
    2. Sprzedawca nie doprowadził Produktu do zgodności z Umową w sposób i na zasadach określonych w ust. 5;
    3. brak zgodności Produktu z Umową występuje nadal, mimo że Sprzedawca próbował doprowadzić Produkt do zgodności z Umową;
    4. brak zgodności Produktu z Umową jest na tyle istotny, że uzasadnia obniżenie ceny albo odstąpienie od Umowy bez uprzedniego skorzystania z uprawnień określonych w ust. 4;
    5. z oświadczenia Sprzedawcy lub okoliczności wyraźnie wynika, że nie doprowadzi on Produktu do zgodności z Umową w rozsądnym czasie lub bez nadmiernych niedogodności dla Konsumenta.

  5. Spory między Sprzedawcą a Klientem, o którym mowa w ust. 1, rozstrzyga sąd właściwy miejscowo dla adresu Sprzedawcy wskazanego w § 1 ust. 2.

§ 12. Pozasądowe sposoby rozpatrywania reklamacji i dochodzenia roszczeń

  5. Skorzystanie z pozasądowych sposobów rozwiązywania sporów nie pozbawia Konsumenta prawa do dochodzenia roszczeń przed sądem.

§ 13. Dane osobowe

  1. Administratorem danych osobowych Klientów i Usługobiorców jest Sprzedawca.

§ 3. Electronic Services

  1. Through the Store, the Seller provides the following Electronic Services free of charge:
    1. the Cart;
    2. the order form, which allows an Order to be placed;
    3. the Account;
    4. the Newsletter;
    5. the contact form, available at /pages/contact;
    6. the Online Withdrawal Form, available at /pages/withdrawal.
  2. To use the Store and the Electronic Services, the following are needed:
    1. a device with internet access;
    2. an up-to-date web browser with JavaScript and cookies enabled;
    3. an active email address (for placing Orders and for using the Account, the Newsletter and the forms).
  3. The User must use the Store in accordance with the law, these Terms and good practice. The User must not provide unlawful content, in particular through the forms available in the Store.
  4. Using services provided electronically involves the typical risks of the internet, such as malicious software, attempts to obtain data by deception (phishing) and unsolicited messages (spam). To reduce them, it is recommended to use up-to-date software, including antivirus software, and not to share one-time Account login codes with other people.
  5. Contracts for Electronic Services are concluded and terminated as follows:
    1. Cart: the contract is concluded when the first Product is added to the Cart and ends when the Order is placed or when the User stops using the Cart;
    2. order form: the contract is concluded when the User starts filling in the form and ends when the Order is placed or when the User stops using the form earlier;
    3. Account: the contract is concluded when the User first logs in to the Account with their email address and a one-time code sent to that address; the contract is concluded for an indefinite period; the User may terminate it at any time, without giving a reason, with immediate effect, by sending the Seller an email requesting deletion of the Account; deleting the Account does not affect Contracts concluded earlier;
    4. Newsletter: the contract is concluded when the User subscribes to the Newsletter using the form available in the Store, by providing an email address; subscribing requires giving, in the signup form, consent to receive commercial information electronically at the email address provided; this consent can be withdrawn at any time; the contract is concluded for an indefinite period; the User may terminate it at any time, without giving a reason, with immediate effect, by clicking the unsubscribe link included in every message or by sending the Seller such a request by email;
    5. contact form and Online Withdrawal Form: the contract is a one-off contract, concluded when the User starts using the form and ending when the form is sent or when the User stops using it earlier.
  6. The Seller may terminate the Account contract or the Newsletter contract with 14 days' notice, by sending the User a statement by email, only for important reasons, which are: the Seller ceasing to provide the given Electronic Service or to run the Store, or a breach of these Terms by the User, in particular providing unlawful content, if the breach continues despite a request to stop it.
  7. Complaints about Electronic Services can be submitted by email or in writing to the addresses given in § 1 section 3. It is recommended to include the User's email address and a description of the problem in the complaint. The Seller reviews the complaint and responds within 14 days of receiving it, to the User's email address, or in writing if the User submitted the complaint in writing and did not give an email address.

§ 4. Placing Orders and concluding the Contract

  1. Information about Products published in the Store, in particular their descriptions, photos and prices, is an invitation to conclude a contract and not an offer within the meaning of the Civil Code.
  2. Orders can be placed 24 hours a day, 7 days a week. Placing an Order does not require an Account.
  3. To place an Order, the Customer:
    1. chooses a Product and its variant (in particular size, finish or framed version) and adds it to the Cart;
    2. goes to the order form;
    3. enters an email address and, for Physical Products, delivery details;
    4. chooses a delivery method and a payment method;
    5. reviews the Order summary, which shows in particular the Products, their main features and the total price including delivery costs and any other costs;
    6. clicks the "Pay now" button (or a button with an equivalent meaning in another language version of the order form), which means placing an order with an obligation to pay, and makes the payment.
  4. Until the button referred to in section 3 point 6 is clicked, the Customer can check and correct the data entered, change the contents of the Cart or decide not to place the Order.
  5. The Customer must provide true data that allow the Contract to be performed.
  6. Placing an Order constitutes the Customer's offer to the Seller to conclude a Contract.
  7. After the Order is placed, the Seller sends a message to the email address given by the Customer confirming acceptance of the Order. The Contract is concluded when the Customer receives this message.
  8. The Contract is concluded in Polish or English, subject to § 15.
  9. The Seller provides the Consumer with confirmation of the Contract on a Durable Medium within a reasonable time after it is concluded and no later than at the time the Product is delivered: by email or as a printed copy enclosed in the parcel with the Physical Product. The confirmation contains the information required by law, including the text of these Terms and the model withdrawal form (Annex 1). For a Digital Product, the confirmation is sent by email.
  10. If, after the Contract is concluded, it turns out that it cannot be performed, the Seller will inform the Customer without delay and refund the full payment received without delay, no later than within 14 days. This does not exclude or limit the Customer's rights under the law.
  11. Product photos may differ from the actual appearance of the Products, in particular because of the screen settings of the Customer's device and because the effect of the holographic foil changes with the light and the viewing angle. This does not limit the Seller's liability for the conformity of the Product with the Contract.

§ 5. Prices and payments

  1. Product prices shown in the Store are final prices in Polish zloty (PLN). They are gross prices that include taxes where applicable.
  2. Product prices do not include delivery costs. Delivery costs are set out in § 6. The total price of the Order, including the price of the Products, delivery costs and any other costs, is shown in the Order summary before the Order is placed.
  3. The price shown at the time the Order is placed is binding on the parties. A change of prices in the Store does not apply to Orders placed before that change.
  4. If an Order includes at least two Physical Products, the price of those Physical Products is automatically reduced by 20%. The discount is calculated on the same terms for all Customers, does not apply to the Digital Product (Wallpaper Pack), and its amount is shown before the Order is placed. The Seller may change or end this promotion with effect for the future; such a change does not apply to Orders placed earlier.
  5. Payments in the Store are made online only, through the Shopify Payments payment system. Available payment methods may include in particular payment cards (Visa, Mastercard, American Express), Apple Pay, Google Pay and Shop Pay. The payment methods available for a given Order are shown in the order form. The Store does not accept cash on delivery.
  6. The Customer must pay the price while placing the Order. If the payment is not completed, the Order is not placed and the Customer may try to place the Order again.
  7. Payments due to the Customer, in particular in the event of withdrawal from the Contract or a price reduction, are refunded using the same payment method the Customer used, unless the Customer has expressly agreed to another refund method that does not involve any costs for them.

§ 6. Fulfillment and delivery

Physical Products

  1. Physical Products are made (printed and, where applicable, framed) after the Contract is concluded. Preparing Physical Products for shipping takes 3 to 5 Business Days from the day the Contract is concluded. After this time, the Products are sent to the Customer.
  2. The Store delivers only to addresses in the following countries: Poland, Australia, Austria, Belgium, Canada, Czechia, Denmark, Finland, France, Germany, Hong Kong, Ireland, Israel, Italy, Japan, Malaysia, Netherlands, New Zealand, Norway, Portugal, Singapore, South Korea, Spain, Sweden, Switzerland, United Arab Emirates, United Kingdom, United States.
  3. Delivery methods and costs:
    1. delivery within Poland, Standard: 20 zł; Standard delivery is free of charge if the total price of the Products in the Order after discounts, excluding delivery, is at least 200 zł;
    2. delivery within Poland, Express (express courier delivery): 65 zł;
    3. delivery to the other countries listed in section 2: 70 zł.
    The delivery cost that applies to a given Order is shown in the order form before the Order is placed.
  4. Parcels within Poland are usually delivered within 1 to 2 Business Days from the day of dispatch. Choosing Express delivery only concerns the way the parcel is delivered after dispatch and does not shorten the preparation time referred to in section 1.
  5. The delivery time of parcels to countries other than Poland depends on the destination country.
  6. Physical Products are delivered by a carrier, by courier or to a parcel locker, depending on the delivery method available in the order form, to the address given by the Customer. After the parcel is dispatched, the Seller sends the tracking number to the Customer's email address, if one is available.
  7. For deliveries to countries outside the European Union, the destination country may charge customs duties and import taxes. These are not included in the price of the Products or in the delivery cost and are paid by the recipient of the parcel.
  8. Whatever the destination country, the Seller delivers a Physical Product to the Consumer without undue delay and no later than 30 days from the day the Contract is concluded. If the Seller does not deliver the Product within this period, the Consumer may call on the Seller to deliver it within an additional, appropriate period and, if that period expires without delivery, withdraw from the Contract, in accordance with Article 5431 of the Civil Code.

Digital Product (Wallpaper Pack)

  1. The Digital Product is supplied electronically, to the email address given in the Order, within 24 hours of the Order being placed, without delivery costs.
  2. To receive and use the Digital Product, an active email address and a device (phone or tablet) that can display image files and set them as wallpaper are needed.
  3. If the Customer does not receive the Digital Product within the time set out in section 1, the Seller asks the Customer to check the spam folder and to contact the Seller by email. In such a case the Consumer has the rights provided for in the Consumer Rights Act, including the right to call on the Seller to supply the Digital Product and, if the Seller does not supply it without delay or within an additional, expressly agreed period, the right to withdraw from the Contract.
  4. The Digital Product is intended solely for the Customer's personal, non-commercial use as wallpaper on their devices. Buying a Digital Product or a Physical Product does not transfer the author's economic rights (copyright) in the works to the Customer; further distribution of the files, including making them available to third parties, requires the consent of the rights holder.

§ 7. Right of withdrawal

  1. The Consumer may withdraw from the Contract within 14 days without giving any reason and without incurring any costs, except the costs set out in sections 8 and 11.
  2. The withdrawal period starts:
    1. for Physical Products: when the Consumer, or a third party indicated by the Consumer other than the carrier, takes possession of the Product, and if the Contract covers several Products delivered separately, in batches or in parts: when they take possession of the last Product, batch or part;
    2. for the Digital Product: on the day the Contract is concluded.
  3. The right of withdrawal also applies to Physical Products printed or framed after the Order is placed. These Products are made according to the Store's offer, and choosing a design, size, finish or framed version from the variants available in the Store does not constitute making goods to the Consumer's specifications.
  4. To withdraw from the Contract, the Consumer submits a statement of withdrawal to the Seller, in particular:
    1. using the Online Withdrawal Form available at /pages/withdrawal (Withdraw from contract here);
    2. by email to: paugalk.store@gmail.com;
    3. in writing to: PauGalk Design Studio Paulina Gałka, Al. Młodości 45, 23-400 Biłgoraj, Poland.
    The Consumer may use the model withdrawal form in Annex 1 to these Terms, but this is not obligatory. To meet the deadline, it is enough to send the statement before the period expires.
  5. If the Consumer submits the statement of withdrawal using the Online Withdrawal Form or by email, the Seller will send the Consumer, without delay, a confirmation of receipt of the statement on a Durable Medium (by email), including its content and the date and time it was submitted.
  6. In the event of withdrawal, the Contract is considered not to have been concluded.
  7. The Seller refunds to the Consumer all payments made by the Consumer, including the cost of delivering the Product, subject to sections 8 and 13, without delay and no later than 14 days from the day it receives the Consumer's statement of withdrawal. The refund is made using the same payment method the Consumer used, unless the Consumer has expressly agreed to another refund method that does not involve any costs for them.
  8. If the Consumer chose a delivery method other than the cheapest standard delivery method offered by the Seller (in particular Express delivery instead of Standard delivery), the Seller is not obliged to refund the additional costs incurred by the Consumer.
  9. The Seller may withhold the refund until it receives the Product back or until the Consumer provides proof of having sent it back, whichever happens first.
  10. The Consumer must return the Physical Product to the Seller without delay, no later than 14 days from the day on which they withdrew from the Contract, to: PauGalk Design Studio Paulina Gałka, Al. Młodości 45, 23-400 Biłgoraj, Poland. To meet the deadline, it is enough to send the Product back before the period expires. The return does not require the original packaging; the Seller only asks that the Product be packed in a way that protects it from damage in transit.
  11. The Consumer bears the direct cost of returning the Physical Product (the cost of sending it back to the Seller).
  12. The Consumer is liable for any reduction in the value of the Physical Product resulting from using it beyond what is necessary to establish the nature, characteristics and functioning of the Product.
  13. The Consumer may also withdraw from the Contract only with respect to some of the Products covered by the Order. In that case, the refund covers the price actually paid for those Products, taking into account the discount granted. Delivery costs are refunded if the Consumer withdraws from the Contract with respect to all Products covered by the Order. This does not limit the Consumer's other rights under the law.
  14. For the Digital Product (Wallpaper Pack):
    1. the right of withdrawal does not apply only where all of the following conditions are met: the Seller started supplying the Digital Product with the Consumer's express and prior consent, the Consumer was informed before the supply started that they would lose the right of withdrawal once the Seller has performed, and acknowledged this, and the Seller provided the Consumer with confirmation of the Contract on a Durable Medium, including information about the consent given;
    2. if the Consumer did not give such consent or did not acknowledge the loss of the right of withdrawal, or if the Seller did not provide the confirmation referred to in point 1, the Consumer has the right to withdraw from the Contract on general terms for 14 days from the day the Contract is concluded, also when the Digital Product has already been supplied; in such a case the Consumer does not bear any costs for the supply of the Digital Product;
    3. after withdrawing from the Contract, the Consumer must stop using the Digital Product and must not make it available to third parties.
  15. The right of withdrawal is available to the Consumer and to the Sole Trader with Consumer Rights. It is not available to other Customers (§ 11).

§ 8. Lack of conformity of the Product with the Contract (complaints)

  1. The Seller must deliver a Product that conforms to the Contract.
  2. The Seller is liable to the Consumer for any lack of conformity of a Physical Product with the Contract that existed at the time of delivery and became apparent within two years of that time. A lack of conformity that becomes apparent within two years of delivery of the Physical Product is presumed to have existed at the time of delivery, unless proven otherwise or unless this presumption cannot be reconciled with the nature of the Product or the nature of the lack of conformity.
  3. The Seller is liable to the Consumer for any lack of conformity of the Digital Product with the Contract that existed at the time of supply and became apparent within two years of that time. A lack of conformity that becomes apparent within one year of supply of the Digital Product is presumed to have existed at the time of supply.
  4. If a Physical Product does not conform to the Contract, the Consumer may request its repair or replacement. The Seller may replace the Product when the Consumer requests repair, or repair it when the Consumer requests replacement, if bringing the Product into conformity with the Contract in the way chosen by the Consumer is impossible or would require excessive costs for the Seller. If both repair and replacement are impossible or would require excessive costs, the Seller may refuse to bring the Product into conformity with the Contract.
  5. The Seller carries out the repair or replacement within a reasonable time from the moment the Consumer informed it of the lack of conformity, and without excessive inconvenience to the Consumer. The costs of repair or replacement, including in particular the costs of postage, transport, labor and materials, are borne by the Seller. The Consumer makes the Product to be repaired or replaced available to the Seller, and the Seller collects it at its own cost, in particular by telling the Consumer how to send the Product back at the Seller's expense.
  6. The Consumer may submit a statement of price reduction or of withdrawal from the Contract if:
    1. the Seller refused to bring the Product into conformity with the Contract;
    2. the Seller did not bring the Product into conformity with the Contract in the manner and on the terms set out in section 5;
    3. the lack of conformity of the Product with the Contract persists even though the Seller tried to bring the Product into conformity with the Contract;
    4. the lack of conformity of the Product with the Contract is so significant that it justifies a price reduction or withdrawal from the Contract without first using the remedies set out in section 4;
    5. it is clear from the Seller's statement or from the circumstances that the Seller will not bring the Product into conformity with the Contract within a reasonable time or without excessive inconvenience to the Consumer.
  7. The Consumer may not withdraw from the Contract if the lack of conformity of the Product with the Contract is minor. A lack of conformity is presumed to be significant.
  8. The Seller refunds to the Consumer the amount due as a result of a price reduction without delay, no later than 14 days from the day it receives the statement of price reduction. If the Consumer withdraws from the Contract because a Physical Product does not conform to the Contract, the Consumer returns the Product to the Seller without delay at the Seller's cost, and the Seller refunds the price without delay, no later than 14 days from the day it receives the Product or proof that it was sent back.
  9. If the Digital Product does not conform to the Contract, the Consumer may request that it be brought into conformity with the Contract, in particular by resending the correct files, at the Seller's cost. If bringing it into conformity is impossible, requires excessive costs, did not happen within a reasonable time or the lack of conformity persists, and in other cases provided for in the Consumer Rights Act, the Consumer may submit a statement of price reduction or of withdrawal from the Contract. The Seller refunds the amount due without delay, no later than 14 days from the day it receives the statement.
  10. A complaint can be submitted by email to paugalk.store@gmail.com or in writing to: PauGalk Design Studio Paulina Gałka, Al. Młodości 45, 23-400 Biłgoraj, Poland.
  11. To make it easier to process the complaint, the Seller asks the Consumer to include: their full name, contact details, the Order number, a description of the lack of conformity and the date it was noticed, the Consumer's request and, if possible, photos of the Product. The absence of any of these elements does not prevent the complaint from being processed.
  12. The Seller responds to the Consumer's complaint within 14 days of receiving it, on paper or on another Durable Medium, in particular by email. If the Seller does not respond within this period, the complaint is deemed to have been accepted.

§ 9. Damage in transit

  1. If a Physical Product is delivered damaged in transit, the Customer may report this to the Seller by email to paugalk.store@gmail.com, giving the Order number and attaching a photo of the damaged Product.
  2. After receiving the report, the Seller will send the Customer a new copy of the Product free of charge. The Customer does not need to send the damaged Product back.
  3. The Seller asks that the report be made as soon as possible after the parcel is received. Using the solution described in sections 1 and 2 does not depend on meeting any particular deadline or on drawing up a damage report with the carrier.
  4. The solution described in this paragraph is an additional benefit provided by the Seller and does not exclude, limit or suspend the Consumer's rights in respect of the lack of conformity of the Product with the Contract set out in § 8. The Consumer may use those rights instead of or independently of this solution, in particular if sending a new copy of the Product is not possible.

§ 10. Sole Traders with Consumer Rights

  1. The provisions of these Terms concerning the Consumer that relate to Contracts concluded at a distance, including the right of withdrawal (§ 7), the lack of conformity of the Product with the Contract (§ 8) and the Digital Product, also apply to the Sole Trader with Consumer Rights, in accordance with Article 7aa of the Consumer Rights Act.
  2. The Sole Trader with Consumer Rights is also protected against unfair contract terms on the terms set out in the Civil Code.
  3. If the content of the Contract does not show whether the Contract is of a professional nature for a Customer who is a natural person running a business, that Customer may, at the latest when the Contract is concluded, declare that the Contract is or is not of a professional nature for them, in particular in an email sent to the Seller before placing the Order. The Seller does not make the conclusion of the Contract conditional on such a declaration.
  4. § 11 does not apply to the Sole Trader with Consumer Rights.

§ 11. Provisions for Customers who are not consumers

  1. This paragraph applies only to Customers who are neither Consumers nor Sole Traders with Consumer Rights.
  2. The Customer referred to in section 1 does not have the right of withdrawal set out in § 7.
  3. The Seller is liable to the Customer referred to in section 1 under the statutory warranty for defects (rękojmia) on the terms set out in the Civil Code, provided that:
    1. liability under the statutory warranty for physical defects expires if the defect is not discovered within one year of the day the Product was handed over;
    2. the Customer must inspect the Product without delay after receiving it and notify the Seller of any defect found without delay, in accordance with the Civil Code.
  4. The Seller's liability to the Customer referred to in section 1 under the Contract is limited to the price paid for the Product and the cost of its delivery and does not cover lost profits. This limitation does not apply to damage caused intentionally or through gross negligence.
  5. Disputes between the Seller and the Customer referred to in section 1 are resolved by the court having local jurisdiction over the Seller's address given in § 1 section 2.

§ 12. Out-of-court complaint handling and redress

  1. The Consumer may use out-of-court methods of handling complaints and pursuing claims. Participation in out-of-court dispute resolution proceedings is voluntary for both parties.
  2. In particular, the Consumer may:
    1. apply to the provincial inspector of the Trade Inspection (wojewódzki inspektor Inspekcji Handlowej) for mediation and, if a permanent consumer arbitration court operates at that inspectorate, also for the case to be heard by that court; in the province where the Seller runs its business, mediation in consumer matters is conducted by the Lublin Provincial Inspector of the Trade Inspection (Lubelski Wojewódzki Inspektor Inspekcji Handlowej w Lublinie), ul. Tomasza Zana 38 C, 20-601 Lublin, www.ihlublin.pl;
    2. obtain free help from a district (municipal) consumer ombudsman (powiatowy lub miejski rzecznik konsumentów) or from a social organization whose statutory tasks include consumer protection;
    3. consult the list of entities authorized to conduct out-of-court consumer dispute resolution proceedings, kept by the President of the Office of Competition and Consumer Protection (UOKiK), at polubowne.uokik.gov.pl, and the information available at prawakonsumenta.uokik.gov.pl.
  3. A Consumer resident in another Member State of the European Union, in Norway or in Iceland may ask the European Consumer Centre in their country of residence for free help with a cross-border dispute.
  4. If a dispute is not resolved following a complaint submitted by the Consumer, the Seller will provide the Consumer, on paper or on another Durable Medium, with a statement agreeing or refusing to take part in out-of-court consumer dispute resolution proceedings.
  5. Using out-of-court dispute resolution methods does not deprive the Consumer of the right to pursue claims in court.

§ 13. Personal data

  1. The controller of the personal data of Customers and Users is the Seller.
  2. The rules for processing personal data, including the purposes and legal bases of processing and the rights of data subjects, are set out in the Privacy Policy available at /policies/privacy-policy.
  3. Providing personal data is voluntary but necessary to conclude and perform the Contract or to provide Electronic Services.

§ 14. Product safety

  1. The manufacturer of the Physical Products within the meaning of Regulation (EU) 2023/988 of the European Parliament and of the Council of 10 May 2023 on general product safety is: PauGalk Design Studio Paulina Gałka (brand Paugalk), Al. Młodości 45, 23-400 Biłgoraj, Poland, email: paugalk.store@gmail.com.
  2. A Physical Product is identified by its name, its variant (in particular size, finish and framed version) and its photo, shown on the Product page in the Store and in the Order confirmation.
  3. Warnings and safety information, where relevant to a given Physical Product, are given on the Product page in the Store and, where the law so requires, also on the Product, its packaging or an accompanying document.
  4. Information or reports concerning the safety of Products can be sent to the Seller's email address.

§ 15. Language versions

  1. These Terms were drawn up in Polish. The Polish version of the Terms (Regulamin) is published at /pages/regulamin.
  2. The English version of the Terms (Terms of Service), available at /policies/terms-of-service, is a translation. If the language versions of the Terms differ, a Consumer may rely on the version that is more favorable to them. This does not affect the protection granted to the Consumer by mandatory provisions of law.
  3. The Customer may contact the Seller in Polish or English.

§ 16. Changes to the Terms

  1. The Seller may change these Terms only for important reasons, which are:
    1. a change in the law affecting the content of the Terms;
    2. an obligation arising from a court judgment or a decision of a competent authority;
    3. a change in the available payment or delivery methods;
    4. the introduction of new Electronic Services, or a change to or withdrawal of existing ones;
    5. a change in the Seller's details;
    6. the need to ensure the security of the Store or its users.
  2. The Seller announces a change to the Terms by publishing the new Terms in the Store at least 14 days before the changes take effect. Users who have an Account or who are subscribed to the Newsletter are also informed of the change by email within the same period. If the law, a judgment or a decision of an authority requires a change to be made within a shorter period, the change may take effect within the period so required.
  3. A User who does not accept the changes to the Terms may, before they take effect, terminate the Account contract or the Newsletter contract with immediate effect, in the way described in § 3 section 5.
  4. Orders placed before the changes to the Terms take effect are fulfilled under the Terms in force on the day the Order was placed.

§ 17. Final provisions

The choice of Polish law does not deprive a Consumer whose habitual residence is in another country of the protection granted to them by provisions that cannot be excluded by agreement under the law of the country of their habitual residence.
  2. Disputes between the Seller and a Consumer or a Sole Trader with Consumer Rights are resolved by the court having jurisdiction under generally applicable law.
  3. In matters not covered by these Terms, generally applicable law applies, in particular the Civil Code, the Consumer Rights Act and the Act of 18 July 2002 on the provision of electronic services.
  4. Annex 1 is an integral part of these Terms.
  5. These Terms apply from 2 October 2026.
